The Senate Tuesday resolved to have Vice-President Goodluck Jonathan as Acting President until President Umar Musa Yar'Adua returns from his medical trip abroad and is fit to return to his position.

The senate resolution Tuesday was the climax of intensive lobbying by both Pro-Jonathan Senators and the Pro-Yar'Adua group in the upper legislative House.

It would be recalled that the Governors Forum, the Arewa Consultative Forum and even the Information Minister Prof. Dora Akunyili, have all called for the official recognition of Jonathan Goodluck as acting President pending the full recovery of ailing President Yar'Adua who has been away for over 70 days on medical trip in Saudi Arabia. As is usual in Nigeria, a desirable goal has been achieved via a dubious nad questionable route. While every right-thinking person would agree that a formal (if temporary) transfer of power to Jonathan was overdue, few would agree with the moethod adopted by the senate. One of the reasons Nigeria is at the bottom of every measurable index of development (politically, socially, economically etc) today is our scant regard for our own laws. The provisions of the constitution on this matter are clear and those provisions do not include a senate proclamation, resolution or any other act by whatever name called. If indeed the president was well enough to sign the 2009 supplementary appropriation bill why can he not write that simple, one paragraph letter to the NASS about his sick leave , as required by the constitution ? I hope this flouting of the constitution will be challenged in court. LET US LEARN TO DO THINGS THE LAWFUL WAY !!!

i am not a lawyer, however, i believe that the motions moved by the national assembly are totally unconstitutional by the letters and the spirit of the 1999 Nigerian constitution. it cannot stand the test of time or the law courts. these guys are just taking Nigerians for a ride. let them continue, a day will come.......

Well, I will say this is a good news for Nigerians but one question still remain, can Acting President Jonathan Ebele Goodluck dissolve the old cabinet. Does Constitution permit him that?. But if Constitution permits him, I think that should be the next agenda the Acting President Jonathan Ebele Goodluck must look in to immediately. For me, he ought to dissolve the old cabinet and form his own cabinet immediately to enable him work.
The new cabinet can set a panel for the Medical reports of Umar Musa Yar’Adua. With that I think there will be no failure in his government.
Again, the new cabinet must not be involve with the old cabinet. I wish the Acting President Jonathan more wisdom and good luck as his surname sounds.
