BACKGROUND INFORMATION

 

              The legal proceedings between Comandclem Nigeria Limited and twenty-two infringing companies came up for the third times in the Federal High Court Calabar Judicial Division of Nigeria on 8th of March, 2012. The nature of the legal battle between Comandclem Nigeria Limited and twenty-two infringing companies is in connection with patent right infringement litigation traceable to the execution of ANTON PILLAR ORDER issued by the Federal High Court Calabar Judicial Division of Nigeria on 5th of September, 2000 to the sole inventor of ANTI-CORROSIVE SPECIAL PAINT FOR QIT – PROFESSOR CJA UWEMEDIMO. This ANTON PILLAR ORDER empowered PROFESSOR CJA UWEMEDIMO to search the premises and offices of those twenty-two infringing companies for the purpose of determining whether or not they manufacture, sale or store the patented invention of PROFESSOR CJA UWEMEDIMO called of ANTI-CORROSIVE SPECIAL PAINT FOR QIT (TRANSTEEL BLUE, WHITE ENAMEL QAD) with a Nigerian Patent Office Certificate Number RP 13522, and World Intellectual Property Organization (WIPO) registered number   PCT/GB/2010/000074.  


          While executing the ANTON PILLAR ORDER, the chemical ingredients / chemical substances of ANTI-CORROSIVE SPECIAL PAINT FOR QIT (TRANSTEEL BLUE, WHITE ENAMEL QAD) were caught red-handed in the premises of those twenty-two companies. Those twenty-two companies confessed that Mobil Producing Nigeria Unlimited sold those patented chemical ingredients / chemical substances of ANTI-CORROSIVE SPECIAL PAINT FOR QIT (TRANSTEEL BLUE, WHITE ENAMEL QAD) to them corroborating continuous infringement on the intellectual property of Comandclem Nigeria Limited by Mobil Producing Nigeria Unlimited.


            In respond to the letter of MR. HANRY HAWKIN of 02/07/1980 marked as exhibit 7A, THE KING attached the paint literature/paint manual (the chemical formulas, the trade secret, the chemical ingredients) to a letter marked as exhibit 7AA to guide by Mobil Producing Nigeria Unlimited (MPNU) through the selection of various products of ANTI-CORROSIVE SPECIAL PAINT FOR QIT (TRANSTEEL BLUE, WHITE ENAMEL QAD). From this paint literature or chemical formulas of ANTI-CORROSIVE SPECIAL PAINT FOR QIT (TRANSTEEL BLUE, WHITE ENAMEL QAD) other anti-corrosive substances like MOBIL BLUE, MOBIL RED, MOBIL BEIGE,INTERGARD, and INTERTHANE etc can be manufactured. MOBIL BLUE, MOBIL RED, MOBIL BEIGE, INTERGARD, INTERTHANE are anti-corrosive chemical substances of different colorations derived from ANTI-CORROSIVE SPECIAL PAINT FOR QIT (TRANSTEEL BLUE, WHITE ENAMEL QAD). Mobil Producing Nigeria Limited is a thief and an infringer.


 

COMANDCLEM NIGERIA LIMITED RECORDED AN UNPRECEDENTED PROGRESS ON THE SUIT ON 8TH OF MARCH, 2012

 

               It is not a news that the legal battle between Comandclem Nigeria Limited and twenty-two infringing companies kick started on 19th of November, 2011, and subsequently adjourned to 19th of January, 2012. The judicial proceedings of 19th of January, 2012 called for 8th of March, 2012 settings in the Federal High Court Calabar Judicial Division of Nigeria. Substantial progresses were achieved by PROFESSOR CJA UWEMEDIMO in the suit against those twenty-two (22) infringing companies in the Federal High Court Calabar Judicial Division on 8th of March, 2012. Those substantial progresses are measurable in terms of advancements recorded in the trial of the case at Federal High Court calabar Judicial Division. This unique trial achievement can only be appreciated on a critical assessment of dockets of congestions and unpredictable trial cost and adjournments in the Nigerian Legal System especially in the Federal High Court.


       To be precise, the Federal High Court Calabar Judicial Division ordered for the adoption of FRONT LOADING SYSTEM in the trial of the suit to expedite judicial proceedings in the case. This FRONT LOADING SYSYTEM in the trial of the case will surely eradicate the major drawbacks of the old rules of court previously guiding trial of cases in Nigerian Judicial System taking cognizance of the current CIVIL PROCEDURES RULES in operations. Before this, people generally filed their writ of summons and then waited for years to file their statement of claim. One can see that these new rules are time conscious thereby guaranteeing speedy trials.

WHAT IS A FRONT LOADING SYSTEM IN CIVIL PROCEDURE RULES IN RELATION TO A TRIAL BEFORE A COURT OF COMPETENT JURISDICTION?

                    Front Loading System is a unique system of filing litigation documents ahead of trial to expedite quick dispensation of justice and to avoid costly delay that may emanate in a suit before a court of competent jurisdiction. By litigation documents, I mean

(1)            The Statement of Claim,

(2)          Copies of documents mentioned in the Statement of Claim to be used in evidence,

(3)           The Witness Statement on oath,

(4)           The requirement of a Pre-counseling Certificate.

Under a Front Loading System, the above sets of documents are required to be filed at the outset by the supporting parties. This system of filling litigation documents reduces congestions of cases in court and costly delay in trial of cases because of the fact that the opposing parties have pre-knowledge of evidences of the supporting parties. This will enable opposing parties to plain their defence effectively in the case. Before this, people generally filed their writ of summons and then waited for years to file their statement of claim. WHAT ARE THE LEGAL IMPACTS OF FRONT LOADING SYSTEM IN THE SUIT BETWEEN COMANDCLEM NIGERIA LIMITED AND TWENTY-TWO (22) INFRINGING COMPANIES?

            The legal impacts of applying a front loading system in the litigation between COMANDCLEM NIGERIA LIMITED AND TWENTY-TWO (22) INFRINGING COMPANIES are too many to be emphasized taking into consideration the high expectations CCNL Patentees in recent times. WHAT ARE THE POSSIBLE EVENTS THAT SHALL BE UNCOVERED ON 9TH, 10TH AND 11TH OF MAY, 2012?

 

        We have reported a while ago that the legal battle between Comandclem Nigeria Limited and twenty-two infringing companies has been adjourned to 9th, 10th, and 11th of May, 2012 to call CCNL Witnesses and cross examinations of those Witnesses by the Counsels of twenty-two infringing companies.

INTRODUCTION


      The official report of legal proceedings between COMANDCELM NIGERIA LIMITED and TWENTY-TWO (22) INFRINGERS in the Federal High Court Calabar Judicial Division of Nigeria can only be appreciated if and only if past legal proceedings are succinctly explained to the understanding of an ordinary CCNL PATENTEES. The sole objective of this succinct explanation will enable an ordinary CCNL PATENTEES to monitor the legal trends of events as they unfold in the Federal High Court Calabar Judicial Division. As a result of the above, we shall consider the outcomes of the legal proceedings between COMANDCELM NIGERIA LIMITED and TWENTY-TWO (22) INFRINGERS in the Federal High Court Calabar Judicial Division of Nigeria under the following headings.

        As a result of the documentary evidences obtained while executing ANTON PILLAR ORDER issued on 5th of September, 2000, the Management of COMANDCLEM NIGERIA LIMITED headed by THE GREAT INVENTOR OF ANTI-CORROSIVE SPECIAL PAINT FOR QIT, - KING PROFESSOR CJA UWEMEDIMOH dragged twenty-two (22) intellectual criminals to the Federal High Court Calabar Judicial Division on 19th of November, 2011.
 On that faithful day, the following events unfolded

(1)    THE COURT WAS UNABLE TO SIT
(2)   THE COUNSELS OF THE PARTIES TO THE CASE RESOLVED TO ADJOURN THE CASE TO 19TH OF JANUARY, 2012 FOR MENTIONING AMONG OTHERS.

THE LEGAL PROCEEDINGS OF 19TH OF JANUARY, 2012.


        The outcomes of the resolutions reached between the legal counsels of COMANDCELM NIGERIA LIMITED and TWENTY-TWO (22) INF RINGERS in the Federal High Court Calabar Judicial Division of Nigeria on 19th of November, 2011 to the effect that the case should be adjourned to 19th of January, 2012 for mentioning necessitated the court to sit on the said date. On that day, the following legal event unfolded.

(1)   THE COURT WAS ABLE TO SIT
(2)   THE CASE WAS SUCCESSFULLY MENTIONED IN THE COURT.
The court officially adjourned the case to 8th of March, 2012 for hearing among other things.

            You would remember vividly that the case was adjourned to 8th of March, 2012 for hearing as a result of the fact that the case was mentioned on 19th of January, 2012 at the Federal High Court Calabar Judicial Division. The Management of COMANDCLEM NIGERIA LIMITED headed by KING PROFESSOR CJA UWEMEDIMOH made a substantial progress on the case in the Federal High Court Calabar Judicial Division on 8th of March, 2012.

          The court ordered that the legal Counsel of COMANDCLEM NIGERIA LIMITED should embark on the following legal steps in the suit.

(1)   PRESENTATION OF CCNL WITNESSES.
(2)   PREPARATION FOR CROSS EXAMINATION OF CCNL WITNESSES BY COUNSELS TO TWENTY-TWO (22) INFRINGERS
in the Federal High Court Calabar Judicial Division on 9th, 10th, and 11th of May, 2012.

     Technically speaking, the case has been adjourned to 9th, 10th,and 11th of May,2012 for hearing paying a critical attention to call of CCNL witnesses and subsequent cross examinations of those CCNL witnesses by COUNSELS TOTWENTY-TWO (22) INFRINGERS.

WHAT IS A CROSS EXAMINATION OF CCNL WITNESSES?


  This entails the questioning of CCNL witnesses in a trial, hearing, or deposition by the party (COUNSELS TOTWENTY-TWO (22) INFRINGERS) opposing the one who asked the person to testify in order to evaluate the truth of that person`s testimony, to develop the testimony further, or to accomplish any other objectives.

         Mobil Producing Nigeria Unlimited supposed to have filed a reply to the CCNL BRIEF OF ARGUMENT on 19th of December, 2011 going by the statutory provision of the SUPREME COURT RULE OF 1985, ORDER 6 - Filing of Briefs in Civil And Criminal Proceedings, RULE 5(2)-

                                           

The respondent shall file in the Court and serve on the appellant his own Brief within eight weeks after service on him of the Brief of the appellant.

It is obvious that Mobil Producing Nigeria Unlimited deliberately delayed to file a respond to the CCNL BRIEF OF ARGUMENT at the appropriate time. This is not the first times Mobil Producing Nigeria Unlimited has introduced delay tactics on this case. In the FEDERAL HIGH COURT before Gladys Olotu , Mobil Producing Nigeria Unlimited pleaded to furnish some documents from NNPC. As at today, Mobil Producing Nigeria Unlimited doesn’t produce a sheet of paper in the court from NNPC. We appreciate the pertinence of all the ESTEEM CCNL PATENTEES. Justice can only be delayed but cannot be denied.

 

THE JUDICIAL INTERPRETATIONS OF THE REPLY OF MOBIL PRODUCING NIGERIA UNLIMITED TO COMANDCLEM`S BRIEF OG ARGUMENT IN THE SUPREME COURT OF NIGERIA (SC/69/2011)

 

             The current decision of Mobil Producing Nigeria Unlimited to file a reply to CCNL BRIEF OF ARGUMENT in the apex court of the land denotes a substantial progress in the final judicial determination of this case. According to THE KING PROFESSOR CJA UWEMEDIDOH – “let us give them the opportunities to talk, and let the honorable justices of the supreme court of Nigeria decide the case

    

            In line with the statement of THE KING PROFESSOR CJA UWEMEDIDOH, Mobil Producing Nigeria Unlimited has talked through respond to the CCNL brief of argument some days ago. In Accounting, for every debit entry, there must be a corresponding credit entry to ensure that the trail balances are in harmony. That is to say that for every action, there must be a reaction. The decision of Mobil Producing Nigeria Unlimited to file a reply to CCNL BRIEF OF ARGUMENT in the apex court of the land has the following judicial interpretations in law.

 

(1)          THAT, THERE ARE COMMERCIAL AND BUSINESS RELATIONSHIP BETWEEN COMANDCLEM NIGERIA LIMITED AND MOBIL PRODUCING NIGERIA UNLIMITED.

(2)        THAT, MOBIL PRODUCING NIGERIA UNLIMITED HAS BEEN GIVEN SUFFICIENT FAIR HEARING ON THE CASE SC./69/2011.

(3)        THAT, NO CORPORATE ENTITY IN NIGERIA IS ABOVE THE LAWS OF THE FEDERATION OF NIGERIA. THIS IS TO SAY THAT MOBIL PRODUCING NIGERIA UNLIMITED HAS COMPLIED WITH THE LAWS OF NIGERIA TO THE EXTENT OF FILLING A REPLY IN THE APEX COURT OF THE LAND BUT LATELLY.

(4)        THAT, BARRING ANY UNFORESEEN CIRCUMSTANCES, THE CASE OF PATENT RIGHT INFRINGEMENT LITIGATION LEVELED AGAINST MOBIL PRODUCING NIGERIA UNLIMITED WILL BE CONCLUDED WITHIN A REASONABLE TIME POSSIBLE.

(5)        THAT, FOR ANY WRONG THERE MUST BE A REMEDY.

 

 

 

WHAT IS THE NEXT LINE OF ACTION NOW THAT MOBIL PRODUCING NIGERIA UNLIMITED HAS FILED A REPLY IN THE APEX COURT OF THE LAND

(1)          CCNL SHALL FILE A REPLY TO MPNU RESPOND WITHIN FOUR (4) WEEKS.

The ABLE MANAGEMENT TEAM OF COMANDCLEM NIGERIA LIMITED headed by THE KING PROFESSOR CJA UWEMEDIDOH is expected to file a reply to MPNU respond within four (4) weeks going by the statutory provision of the SUPREME COURT RULE OF 1985, ORDER 6 - Filing of Briefs in Civil And Criminal Proceedings, RULE 5(3)-

 

The appellant may also file in the Court and serve on the respondent a Reply Brief within four weeks after service of the Brief of the respondent on him but, except for good and sufficient cause shown, a Reply Briefs shall be filed and served at least three days before the date set down for the hearing of the appeal.

 

(2)        THE CONTENTS OF MPNU REPLY SHALL BE MADE FOR PUBLIC CONSUMPTION NEXT WEEK FRIDAY
